★ ★ ★ ★ ★ Ho avuto esperienza con questa agenzia piuttosto scioccante. Mi sono rivolta a lei contemporaneamente da venditrice del mio appartamento e da acquirente di nuovo appartamento in casa in costruzione.
A fronte, della vendita del mio appartamento che non possedeva alcuna irregolarità (anzi si e’ rivelato un buon affare per gli acquirenti, conoscenti personali del signor Valtorta), e per il quale l’agenzia ha ottenuto le dovute provvigioni da entrambe la parti, devo denunciare invece le gravi lacune a fronte dell’appartamento in costruzione per il quale ho sottoscritto preliminare di acquisto (compromesso) assistita dall’allora agente di Valtorta.
L’agenzia:
1) non ha eseguito accertamenti sulla solidità del costruttore, (che peraltro conosceva in quanto aveva operato tempo addietro come mediatore per la vendita del terreno del cantiere). Infatti il costruttore aveva già ai tempi della sottoscrizione del mio preliminare, atti pregiudizievoli (ipoteche) a suo carico che con una semplice visura catastale da parte di Valtorta sarebbero stati individuati e resi noti al potenziale acquirente ovvero a me;
2) Non ha preteso dal costruttore ne’ reso nota a me l’obbligatorietà di rilascio della fidejussione bancaria a fronte degli acconti da me versati. Obbligo di legge che l’agenzia, in sede di stesura del preliminare insieme con il costruttore, ha sempre il dovere di segnalare e indicare.
L’ agenzia Valtorta avrebbe dovuto quindi operare osservando due decreti legislativi (122/2005 e 14/2019) che tutelano chi acquista casa dal costruttore.
Morale : il costruttore in questione, totalmente insolvente, e’ letteralmente ‘scomparso’ abbandonando il cantiere forse anche per vizi e irregolarita’ di costruzione; non si effettuerà il rogito; la sottoscritta sta sostenendo ingenti spese legali e l’agenzia Valtorta non riconosce alcuna responsabilità, pur avendone, nonostante le provvigioni incassate, non indifferenti, versate all’atto del compromesso.
 I have had experience with this rather shocking agency. I approached her simultaneously as a seller of my apartment and as a buyer of a new apartment in a house under construction.
On the other hand, the sale of my apartment which did not have any irregularities (indeed it turned out to be a good deal for the buyers, personal acquaintances of Mr. Valtorta), and for which the agency has obtained the necessary commissions from both sides, I must instead report the serious gaps in the apartment under construction for which I signed a preliminary purchase agreement (compromise) assisted by Valtorta's then agent.
The agency:
1) did not carry out checks on the solidity of the builder, (who, moreover, he knew because he had worked long ago as a mediator for the sale of the yard's land). In fact, at the time of the signing of my preliminary agreement, the builder already had prejudicial deeds (mortgages) against him that with a simple cadastral survey by Valtorta would have been identified and made known to the potential buyer or to me;
2) It did not demand from the manufacturer or disclose to me the obligation to issue the bank guarantee against the advances I paid. Legal obligation that the agency, when drafting the preliminary together with the manufacturer, always has the duty to report and indicate.
The Valtorta agency should therefore have operated in compliance with two legislative decrees (122/2005 and 14/2019) which protect those who buy a house from the builder.
Moral: the builder in question, totally insolvent, has literally 'disappeared', abandoning the site, perhaps also due to construction defects and irregularities; the deed will not be carried out; the undersigned is incurring large legal costs and the Valtorta agency does not recognize any responsibility, despite having, despite the not indifferent commissions received, paid at the time of the compromise.
